Please note that the document that was recorded with Mobile County Probate Court on October 27, 2009, under the legal description “Regarding Restrictions on Said Subdivision” actually contained two separate HOA governing documents. The first 30 pages of the scanned document was the actual Declaration of Covenants, which requires a vote of 2/3 of members for an amendment. Beginning on page 31 of the scanned document was the original ARC Guidelines for Briargrove Phase One, which the ARC has the power to amend as they deem necessary. To avoid confusion, the Declaration of Covenants and the current ARC Guidelines are listed separately below.
The document below entitled “Briargrove Declaration of Covenants” originally contained both the Declaration and original ARC Guidelines. Due to the confusion this has created, the original ARC Guidelines were removed from this document. Please refer to the Briargrove Architectural Guidelines below the most up-to-date copy of these guidelines.
